1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Clear Window Ltd. ("Clear Window," "we," "us," or "our") governing your access to and use of the Clear Window platform, including our website, services, and applications (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Eligibility

You must meet the following requirements to use Clear Window:

• Age Requirement: You must be at least 16 years old to create an account and use the Service
• Legal Capacity: You must have the legal capacity to enter into a binding contract
• Compliance: You must not be prohibited from using the Service under applicable laws
• Single Account: You may only maintain one active account

By using the Service, you represent and warrant that you meet these eligibility requirements. We reserve the right to verify your eligibility at any time and may suspend or terminate accounts that do not meet these criteria.

3. Account Registration and Security

Account Creation

To use certain features of Clear Window, you must create an account by providing:

• A valid email address
• A secure password
• A username (pseudonym acceptable)
• Any additional information required for verification

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Using a strong, unique password not shared with other services

Account Accuracy

You must:

• Provide accurate, current, and complete information
• Update your information promptly when it changes
• Not impersonate any person or entity
• Not create multiple accounts or accounts on behalf of others without authorization

4. Permitted Use

Clear Window grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose:

You May:

• Submit verified, honest reviews of properties, services, or landlords you have genuine experience with
• Read and search reviews submitted by other users
• Share reviews via provided sharing functionality
• Update or delete your own reviews
• Manage your account settings and preferences
• Contact customer support for assistance

Commercial Use Restrictions

The Service is provided for personal, non-commercial use only. You may not use the Service for commercial purposes without our prior written consent. This includes but is not limited to:

• Scraping or harvesting review data
• Using the Service to promote commercial products or services
• Reselling or redistributing access to the Service

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

Content Violations

• False Reviews: Submitting reviews for properties or services you have no genuine experience with
• Fraudulent Verification: Providing false documentation or information during the verification process
• Review Manipulation: Attempting to artificially inflate or deflate ratings
• Brigading: Coordinating with others to review bomb or manipulate reviews
• Defamatory Content: Posting content that is false, defamatory, or knowingly misleading
• Hate Speech: Posting content that promotes hatred, violence, or discrimination
• Harassment: Using the platform to harass, threaten, or abuse others

Technical Violations

• Hacking: Attempting to gain unauthorized access to any part of the Service
• System Disruption: Interfering with the proper functioning of the Service
• Automated Access: Using bots, scrapers, or automated tools without authorization
• Reverse Engineering: Attempting to reverse engineer, decompile, or extract source code
• Security Circumvention: Bypassing security features or verification systems

Misuse and Abuse

• Multiple Accounts: Creating multiple accounts to circumvent restrictions or penalties
• Identity Theft: Impersonating another person or entity
• Spam: Posting repetitive, irrelevant, or promotional content
• Malware Distribution: Uploading viruses, malware, or harmful code
• Legal Violations: Using the Service for any illegal purpose

6. Reviews and Content

Review Submission

When you submit a review to Clear Window:

• You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, display, and distribute your review content
• Your review will be anonymized and cannot be linked back to your identity
• You retain ownership of your review content, but grant us the rights necessary to operate the Service
• You represent that your review is truthful, accurate, and based on your genuine experience

Review Standards

All reviews must:

• Be based on your personal, first-hand experience
• Be honest, truthful, and factually accurate to the best of your knowledge
• Relate to the property, service, or landlord being reviewed
• Comply with applicable laws and these Terms
• Not contain personal information of others without their consent
• Not contain obscene, offensive, or inappropriate language (unless necessary for accurate description)

Review Moderation

We reserve the right to:

• Review, edit, or remove content that violates these Terms
• Use automated and manual moderation tools
• Apply our smart weighting algorithm to adjust review visibility
• Request additional verification for suspicious reviews
• Remove reviews flagged as fraudulent or abusive

Review Deletion

Important: Due to our anonymization process, once a review is published and anonymized, we cannot link it back to your identity to delete it. You can delete reviews only before the anonymization process is complete (typically within 24 hours of submission). After anonymization, reviews serve the public interest and remain published indefinitely.

Right to Respond

Property owners, landlords, and service providers have the right to respond to reviews through our verified response system. Responses must also comply with these Terms and our content standards.

7. Verification Process

Verification Requirement

To maintain platform integrity, all reviewers must complete our verification process before their reviews are published. This ensures that reviews come from individuals with genuine connections to the properties or services reviewed.

Verification Documentation

You may be required to provide:

• Proof of address (utility bills, lease agreements, etc.)
• Documentation showing your connection to the property or service
• Additional verification information as needed

Document Processing

By uploading verification documents, you:

• Consent to our processing of these documents for verification purposes only
• Acknowledge that documents will be permanently deleted within 48 hours of verification
• Understand that only verification status (not your identity) will be linked to your review

Verification Rejection

We may reject verification and decline to publish reviews if:

• Documentation is insufficient, unclear, or fraudulent
• We cannot verify your connection to the property or service
• The review violates our content standards
• We detect suspicious patterns or potential fraud

8. Intellectual Property

Our Rights

Clear Window and all associated intellectual property rights are owned by Clear Window Ltd. This includes:

• The Clear Window name, logos, and branding
• The platform design, layout, and user interface
• Our proprietary verification and anti-brigading algorithms
• All software, code, and technology underlying the Service
• Content we create (excluding user-generated reviews)

Your Rights

You retain ownership of the content you submit, but grant us the licenses described in Section 6. You may not use our intellectual property without our prior written permission.

Third-Party Content

The Service may contain links to third-party websites or services. We do not endorse or assume responsibility for third-party content. Your interactions with third parties are solely between you and them.

Copyright Infringement

We respect intellectual property rights. If you believe content on Clear Window infringes your copyright, please contact us at copyright@clearwindow.com with:

• Description of the copyrighted work
• Location of the infringing material
• Your contact information
• A statement of good faith belief that use is unauthorized
• A statement under penalty of perjury that your information is accurate

9. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you also agree to our Privacy Policy.

10. Disclaimers

Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

No Guarantee of Accuracy

While we implement verification and anti-fraud measures, we do not guarantee the accuracy, completeness, or reliability of user-generated reviews. Reviews represent the opinions and experiences of individual users, not Clear Window.

No Professional Advice

The Service is not intended to provide legal, financial, or professional advice. You should consult qualified professionals for specific advice related to your circumstances.

Service Availability

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may suspend or terminate the Service for maintenance, updates, or other reasons without prior notice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAR WINDOW, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR USE
• PERSONAL INJURY OR PROPERTY DAMAGE
• DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE
• DAMAGES ARISING FROM USER-GENERATED CONTENT OR REVIEWS
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Clear Window, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit to the Service
• Your fraudulent or illegal activities

13. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.

Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@clearwindow.com to attempt to resolve the matter informally. We'll work in good faith to resolve disputes within 30 days.

Arbitration Agreement

If informal resolution fails, you agree that disputes will be resolved through binding arbitration rather than in court, except where prohibited by law. Either party may seek injunctive relief in court for intellectual property disputes or breaches of confidentiality.

Class Action Waiver

You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration, except where such waiver is prohibited by law.

Exceptions

This arbitration agreement does not apply to users in jurisdictions where arbitration agreements are not enforceable (e.g., European Union). Users in those jurisdictions may bring claims in their local courts.

14. Termination

Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in your settings
• Contacting us at support@clearwindow.com

Upon termination, your personal information will be deleted according to our Privacy Policy. Anonymized reviews will remain published.

Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• We suspect fraudulent or illegal activity
• We're required to do so by law
• Continued provision of Service creates legal risk
• You engage in abusive or harassing behavior

Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account data (subject to legal retention requirements)
• Sections of these Terms that by their nature should survive termination will remain in effect
• Anonymized reviews will remain published for the public interest

15. Changes to Terms

We may update these Terms from time to time. When we make material changes:

• We'll update the "Effective Date" at the top of this page
• We'll notify you via email or prominent notice on the platform
• Changes will take effect 30 days after notification for existing users
• Continued use after changes take effect constitutes acceptance

If you don't agree with changes, you must stop using the Service and delete your account before the changes take effect.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Clear Window.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer our rights and obligations without restriction.

Force Majeure

We shall not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service provider failures.

Language

These Terms are written in English. Any translated versions are provided for convenience only. In case of conflict, the English version prevails.
